1. Agreement to Terms
By accessing or using TheForja's services, you agree to be bound by these Terms of Service. If you disagree with any part, you may not access our services.
2. Services Description
TheForja provides AI-powered operational services for manufacturing MSMEs including:
- Office automation and data processing
- Business intelligence and reporting
- Financial hygiene and compliance tracking
- Digital presence management
- Custom bot development (Pro plan)
3. Subscription Terms
3.1 Subscription Plans
- Standard Plan: ₹15,000/month + GST
- Pro Plan: ₹20,000/month + GST
3.2 Billing
- Subscriptions are billed monthly in advance
- Auto-renewal applies unless cancelled 7 days before renewal
- All prices exclude GST and applicable taxes
4. Client Responsibilities
You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Provide necessary data and access for automation
- Maintain your VPS infrastructure (for Pro plan)
- Comply with all applicable laws and regulations
- Not use services for illegal or unauthorized purposes
5. Our Responsibilities
We agree to:
- Provide services as described in your chosen plan
- Maintain human verification for all AI outputs
- Operate on replica data to protect master files
- Provide timely support during business hours
- Keep your data confidential and secure
6. Intellectual Property
6.1 Your Ownership
- You own all data you provide
- You own custom bot code we develop (Pro plan)
- You own VPS infrastructure and configurations
6.2 Our Ownership
- TheForja brand, website, and marketing materials
- Our proprietary methodologies and processes
- General-purpose automation templates
7. Limitation of Liability
TheForja shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of profits, data, or business opportunities
- Errors in client-provided data
- Issues arising from client's VPS infrastructure
- Third-party service failures
Maximum Liability: Limited to fees paid in the 3 months preceding the claim.
8. Service Level Agreement (SLA)
- Uptime Target: 99% (excluding scheduled maintenance)
- Response Time: 24 hours for non-urgent queries
- Bot Deployment: Within 5 business days (Pro plan)
- Support Hours: Monday-Saturday, 9 AM - 7 PM IST
9. Termination
9.1 By You
You may cancel at any time with 7 days notice. See our Refund Policy for details.
9.2 By Us
We may terminate your account if you:
- Violate these terms
- Fail to pay for 15+ days
- Use services for illegal purposes
- Abuse or harass our team
10. Confidentiality
Both parties agree to:
- Keep confidential information private
- Use confidential information only for service delivery
- Not disclose to third parties without consent
- Return or destroy confidential information upon termination
11. Dispute Resolution
11.1 Governing Law
These terms are governed by the laws of India.
11.2 Jurisdiction
Courts of Pune, Maharashtra shall have exclusive jurisdiction.
11.3 Negotiation
Parties agree to attempt good-faith negotiation before litigation.
12. Force Majeure
Neither party is liable for delays or failures due to circumstances beyond reasonable control (natural disasters, war, government actions, internet outages, etc.).
13. Modifications
We may modify these terms with 30 days notice. Continued use after changes constitutes acceptance.
